1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern access to and use of the website www.omrixglobal.com (the "Site") and the purchase of any products offered for sale on the Site ("Products"), operated by Omrix FZ-LLC, a company registered in the Ras Al Khaimah Economic Zone, with its registered address at FDBC4203, Compass Building, Al Shohada Road, Al Hamra Industrial Zone – Free Zone, Ras Al Khaimah, United Arab Emirates ("Omrix", "we", "us", or "our").
By accessing the Site, creating an account, or placing an order, you ("Customer" or "you") confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, each incorporated by reference. If you do not agree to these Terms, please do not use the Site or place an order.
We may update these Terms from time to time as described in Section 15 (Changes to These Terms). Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
2. Eligibility
To place an order on the Site, you must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and legally capable of entering into a binding contract. If you are a minor, purchases may only be made by, or with the direct involvement and consent of, a parent or legal guardian who accepts these Terms on your behalf.
By placing an order, you represent and warrant that all information you provide is accurate, current, and complete, and that you meet the eligibility requirements set out in this Section.
3. Geographic Availability
Standard online sales and fulfilment through the Site are currently intended for customers located in the United States and the United Arab Emirates. Orders from other countries may be accepted only where that destination is expressly enabled at checkout.
Omrix does not sell or ship Products to any country, region, or individual subject to applicable trade sanctions, embargoes, or other legal or regulatory restrictions. We reserve the right to refuse or cancel any order that we reasonably believe violates this Section.
4. Products, Descriptions, and Pricing
4.1 Product Listings
We aim to display Product descriptions, images, and specifications as accurately as possible. However, we do not warrant that Product descriptions, images, or other content on the Site are accurate, complete, current, or error-free. Minor variations in color, packaging, or appearance may occur.
4.2 Availability
Products are generally listed for sale only when in stock. From time to time we may offer selected Products or new launches on a pre-order basis; any such pre-order will be clearly identified as such, together with an estimated dispatch or delivery timeframe on the relevant product page.
4.3 Pricing and Currency
Product prices are displayed in AED for customers browsing from the United Arab Emirates and in USD for customers browsing from the United States, for reference purposes; however, all orders are processed and charged in USD at checkout.
Unless expressly stated otherwise, applicable VAT, sales tax, or other government taxes are calculated at checkout based on your delivery destination and applicable law. The final USD amount displayed at checkout, inclusive of any applicable taxes and shipping charges, is the total amount payable for your order.
4.4 Changes to Prices and Availability
We may change prices, promotions, Product specifications, bundles, and availability at any time before an order is accepted. Once we issue an order confirmation, the confirmed price for that order will not change, except where an obvious pricing or typographical error has occurred, where fraud is suspected, or where a change is required by law, in which case we will contact you before proceeding and you will have the option to cancel the affected order.
5. Orders and Order Acceptance
Placing an order through the Site constitutes an offer by you to purchase the relevant Product(s) subject to these Terms. All orders are subject to acceptance and availability. We reserve the right to refuse, limit, or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, unauthorized or illegal activity, or where a Product is unexpectedly unavailable, in which case we will notify you and, where payment has already been taken, issue a full refund.
A contract of sale is formed only when we send you an order confirmation email or equivalent notification. Receipt of an order acknowledgment does not, by itself, constitute acceptance of your order.
6. Payments
6.1 Accepted Payment Methods
Omrix currently accepts payment via Visa, Mastercard, American Express, Discover, Diners Club, and JCB, together with Apple Pay, Google Pay, and PayPal express checkout where available, processed through our Shopify checkout. The availability of specific cards or digital wallets may vary depending on your location, device, browser, and payment provider.
6.2 Payment Processing
Payment is processed securely through our third-party payment providers and Shopify. Omrix does not directly store your full card details except as permitted by those systems. By providing payment information, you represent that you are authorized to use the relevant payment method.
6.3 Refund Method
Approved refunds are returned to the original payment method used for the purchase. Where the original payment method is no longer available or valid, Omrix may, with your agreement and where permitted by law, offer an alternative refund method or store credit.
7. Shipping and Delivery
Omrix currently ships using local or regional fulfilment to the United States and the United Arab Emirates. Shipping to additional destinations may be introduced only where enabled at checkout and supported by our logistics partners.
Estimated delivery timeframes are approximately 3–8 business days within the United States and 1–4 business days within the United Arab Emirates, measured from dispatch, subject to carrier capacity, customs processes, and delays in remote areas. Delivery estimates are provided in good faith and are not guaranteed.
Customers are not responsible for customs duties or import taxes on orders placed through the Site. Any such charges, where applicable, are the responsibility of Omrix or are already reflected in the price paid, as further described in our Shipping Policy.
Risk of loss and title to Products pass to you upon delivery to the shipping address provided at checkout. Please inspect your order upon receipt and notify us promptly of any issues in accordance with Section 8.
8. Returns, Exchanges, and Cancellations
8.1 Standard Returns
Omrix offers a 30-day return window from the date of delivery for eligible Products, subject to the conditions set out in our Refund Policy. Devices covered by the 30-day satisfaction guarantee may be opened and reasonably tested but must be returned clean, complete with all components, accessories, and proof of purchase.
8.2 Damaged, Defective, or Incorrect Items
Claims relating to damaged, defective, incorrect, or missing items must be reported within 14 days of delivery, together with supporting photographs or video, so that we can investigate and resolve the issue promptly.
8.3 Non-Returnable Items
The following are generally non-returnable, without limiting your statutory rights: gift cards (if offered), Products clearly marked as final sale, Products damaged through misuse or unauthorized modification, and returns missing essential components. This Section does not affect your rights relating to defective, damaged, or incorrectly supplied Products under applicable law.
8.4 Return Shipping Costs
For change-of-mind returns, the cost of return shipping will be deducted from your refund, and the amount will be communicated to you before the return is approved. Omrix will cover return shipping costs for Products that are defective, damaged, incorrect, or incomplete.
8.5 Order Cancellation
You may request cancellation of an order at any time before it has entered processing or been dispatched. Once processing or shipping has begun, cancellation may no longer be possible, and the return and refund provisions of this Section will apply instead.
9. Product Safety and Intended Use
Certain Omrix devices contain stainless-steel or other conductive surfaces and may use EMS (electrical muscle stimulation) and/or LED technology. If you have metal sensitivities, an implanted electronic device such as a pacemaker, are pregnant, have epilepsy, photosensitivity, open wounds, active skin conditions, or any other relevant medical concern, you should consult a qualified healthcare professional before using any Omrix device.
You must carefully read and follow the User Manual and all safety instructions provided with your specific Omrix device before first use, as precautions, contraindications, recommended usage, and operating instructions may vary by product.
Omrix Products are intended for cosmetic and wellness purposes only and are not intended to diagnose, treat, cure, or prevent any disease. They are not a substitute for professional medical advice, diagnosis, or treatment. Individual results may vary, and testimonials, before-and-after images, and reviews reflect individual experiences rather than guaranteed outcomes.
10. Intellectual Property
All content made available on or through the Site, including trademarks, logos, product names, device designs, photographs, videos, graphics, illustrations, website content, text, product descriptions, user manuals, packaging, and software, is owned by or licensed to Omrix and is protected by applicable intellectual property laws.
Except for limited personal, non-commercial use of the Site, no content may be copied, reproduced, modified, distributed, published, displayed, scraped, downloaded, reverse engineered, used to create derivative works, or exploited for any commercial purpose without Omrix's prior written consent, and provided that all intellectual property notices remain intact.
10.1 Media and Press Use
Press or third parties wishing to use Omrix media or branding must obtain prior written approval from Omrix. Any permitted use is subject to our brand guidelines, attribution requirements, approved context, usage period, territory, and any applicable license fee or embargo. Omrix may withdraw permission at any time if the use becomes misleading, unlawful, or damaging to the Omrix brand.
11. Accounts
Creating an Omrix account is optional. You may create an account to access features such as faster checkout, order history, and order tracking, or you may check out as a guest where available.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. Omrix reserves the right to suspend or terminate any account used in violation of these Terms.
12. Privacy and Marketing
Depending on your interactions with the Site, Omrix may collect personal data such as your name, email address, phone number, billing and shipping addresses, account credentials, order and transaction history, payment confirmation details, support communications, reviews, cookies, usage data, and marketing preferences. Card data is processed through our authorized payment providers and Shopify and is not directly stored by Omrix except as permitted by those systems.
We may use your information to provide order updates, customer support, product recommendations, and, where permitted by applicable law and, where required, with your consent, marketing communications. You may unsubscribe or opt out of marketing communications at any time; however, we may continue to send essential service and order-related communications. Further detail on how we collect, use, and protect personal data is set out in our Privacy Policy, which forms part of these Terms.
13. Reviews and User-Generated Content
Omrix may display verified reviews, testimonials, ratings, photographs, videos, and before-and-after content submitted by customers on the Site, social media channels, advertising, emails, and retail materials, together with appropriate disclosures and without materially altering the customer's meaning.
By submitting a review, testimonial, photograph, video, or other content to Omrix, you grant Omrix a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, modify, and display that content for marketing and promotional purposes, subject to applicable law. Use of influencer content is governed by the applicable written agreement between Omrix and the relevant creator.
14. Disclaimers and Limitation of Liability
The Site and Products are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Omrix disclaims all warranties, express or implied, other than those that cannot lawfully be excluded, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, Omrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or any Product, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death, personal injury, fraud, or gross negligence.
15. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our business, legal or regulatory requirements, or for other reasons. The updated Terms will be posted on the Site with a revised "Last updated" date. Material changes will, where required by law, be notified to you in advance. Your continued use of the Site or placement of an order after changes take effect constitutes acceptance of the revised Terms.
16. Dispute Resolution
If a dispute arises out of or relating to these Terms, your order, or your use of the Site, you agree to first contact Omrix Customer Care to seek a good-faith informal resolution. If the matter remains unresolved, the parties may agree to pursue mediation. If informal resolution and, where applicable, mediation do not resolve the dispute, it will be submitted to the competent courts identified in Section 17 (Governing Law and Jurisdiction).
17. Governing Law and Jurisdiction
These Terms and any purchase made through the Site shall be governed by and construed in accordance with the applicable laws of the United Arab Emirates and the applicable rules and regulations of the Ras Al Khaimah Economic Zone Authority. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts of Ras Al Khaimah, United Arab Emirates, unless otherwise required by applicable law, including mandatory consumer-protection law of your country of residence.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Omrix regarding your use of the Site and purchase of Products, superseding any prior agreements.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer these Terms without our prior written consent. Omrix may assign these Terms in connection with a merger, acquisition, or sale of assets.
18.5 Force Majeure
Omrix will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, or disruptions to carriers or supply chains.
